There are two types of Partner Visas : Subclass 820 and Subclass 801.
The Subclass 820 allows partners to live in Australia Temporarily.

Subclass 820 visa is Stepping visa for the Australian partners to convert towards a permanent Residency visa -under subclass 801.

Subclass 801/820 both can be applied together with one application charge, Application will be processed in two steps.

To be eligible, under 801/820 Visa class must be married to or in a de facto relationship with:

  • An Australian citizen
  • An Australian permanent resident
  • An eligible New Zealand citizen

Benefits of a Partner Visa (Subclasses 820 and 801)

  • Partner visa allows you limited benefits, since initial stage is temporary status under 820:
  • Dependent cannot enjoy the rights as Partner since the status of visa is temporary in terms of Live and work in Australia.
  • Education is not free under temporary visa class 820 (without access to government funding)
  • One needs to have Private medical or health care insurance and need to care for their own expense until permanent residency is granted.

Partner visa (subclass 309/100)
Partner visa 309/100 allows partner to visit and stay with spouse or de facto partner is a permanent resident, citizen or eligible New Zealand citizen .

Eligibility Requirements

The difference between Partner Provisional visa subclass 309 and Permanent Partner visa subclass 100

Partner visa – The Prospective Marriage visa (subclass 300)
​The Prospective Marriage visa (subclass 300) is for people who want to come to Australia to marry their prospective spouse.

This temporary visa initially granted for nine months. Partner must be outside before the application submission.  Wedding can be in any country need not necessarily to be be in Australia.

This visa allows you to:

  • Partner to enter Australia before marriage.
  • During the 9 months visa one can travel in and out of Australia as often as they want
  • Can be Eligible to work during the temporary Subclass visa 300 .
  •  Can continue further education in Australia, but with no access to government funding for tertiary nomination study quota or scholarship advantage.
  • Apply for a Travel/Visa-1/300- Partner visa, in Australia, after your marriage.
